Welcome to GoMarketMe. These Terms and Conditions outline the rules and regulations for the use of GoMarketMe’s websites, platform, products, services, APIs, SDKs, documentation, and related systems.

By accessing or using the Marketing Site, the Platform, or any GoMarketMe services, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use GoMarketMe.
Unless otherwise stated, GoMarketMe Technology, LLC and/or its licensors own the intellectual property rights for all material, content, software, documentation, designs, workflows, technology, and other materials made available by GoMarketMe. All intellectual property rights are reserved.

You may not access or use the Marketing Site, Platform, APIs, SDKs, documentation, or services for competitive intelligence, benchmarking, monitoring, copying, reverse engineering, misrepresentation, circumvention, or any purpose that is unlawful, deceptive, abusive, or adverse to GoMarketMe’s legitimate business interests.
If you create an account on the Marketing Site or the Platform, you are responsible for maintaining the security of your account. You are fully responsible for all activities that occur under your account and for any actions taken in connection with your account.
You agree to provide accurate, complete, and current information when creating or using an account. You may not create, access, or use an account using false, misleading, incomplete, or inaccurate information.
GoMarketMe may require verification of your identity, business, app, affiliate relationship, or other account-related information at any time.
You may not impersonate any person or entity, misrepresent your affiliation with any person or entity, create accounts on behalf of undisclosed third parties, or create accounts for the purpose of monitoring, investigating, copying, competing with, or otherwise interfering with GoMarketMe, its users, or its services.
You may not create fake developer accounts, fake affiliate accounts, test accounts under false pretenses, or any other account intended to conceal your identity, affiliation, purpose, or relationship to a third party.
Competitors of GoMarketMe, and persons acting on their behalf, may not access or use the Platform without GoMarketMe’s prior written consent for the purpose of competitive analysis, benchmarking, monitoring, copying features, reverse engineering, gathering non-public information, or developing, improving, or marketing a competing product or service.
Nothing in this section restricts access to publicly available information on the Marketing Site for ordinary lawful purposes. However, access to the Platform, dashboards, workflows, APIs, SDKs, documentation, user interfaces, reports, and other non-public systems is limited to authorized use only.
You may not use bots, crawlers, scrapers, scripts, browser automation, data mining tools, automated agents, or similar methods to access, monitor, copy, extract, index, test, or analyze the Marketing Site, the Platform, APIs, SDKs, documentation, user accounts, campaign data, affiliate data, pricing, workflows, product behavior, or any other GoMarketMe systems or content, except with GoMarketMe’s prior written consent.
You may not use automated or manual methods to collect, harvest, scrape, or compile information from GoMarketMe for competitive, commercial, abusive, or unauthorized purposes.
You may not reverse engineer, decompile, disassemble, inspect, derive, copy, reproduce, modify, circumvent, or attempt to discover the source code, object code, architecture, workflows, algorithms, tracking methods, attribution logic, security measures, or underlying ideas of the Platform, APIs, SDKs, documentation, or services, except to the limited extent such restriction is prohibited by applicable law.
You may not bypass, disable, interfere with, probe, scan, test, or circumvent any authentication, authorization, monitoring, logging, security, rate-limiting, fraud-prevention, or access-control feature.
Any non-public information made available through the Platform, including dashboards, workflows, campaign information, affiliate information, developer information, reports, screenshots, pricing, product behavior, technical implementation details, business processes, account data, and related information, is confidential to GoMarketMe or its users.
You may not disclose, publish, copy, share, sell, transfer, or use non-public Platform information except as necessary for your authorized use of the Platform.
You may not create or use additional accounts to evade suspension, termination, access restrictions, investigation, enforcement, or prior denial of access.
GoMarketMe may associate related accounts using account information, domain information, email addresses, payment information, device information, network information, IP addresses, usage patterns, technical identifiers, and other operational or security signals.
GoMarketMe may monitor use of the Marketing Site, Platform, APIs, SDKs, documentation, and related systems for security, fraud prevention, abuse prevention, service integrity, compliance, and enforcement purposes.
GoMarketMe may collect and preserve account records, access logs, technical logs, communications, device information, network information, usage patterns, and related information as reasonably necessary to operate the services, investigate suspected violations, enforce these Terms, protect the Platform, comply with legal obligations, or cooperate with lawful requests.
GoMarketMe may suspend, restrict, or terminate access to the Marketing Site, Platform, APIs, SDKs, documentation, or services at any time if GoMarketMe reasonably believes that a user has violated these Terms, created an account under false pretenses, accessed the Platform for unauthorized purposes, posed a security, legal, operational, or reputational risk, or acted in a manner adverse to the integrity of the Platform or its users.
GoMarketMe may suspend or terminate accounts without prior notice where immediate action is reasonably necessary to protect GoMarketMe, its users, its systems, or its services.
Suspension or termination does not limit GoMarketMe’s right to preserve relevant information, pursue available legal remedies, or cooperate with lawful investigations.

We reserve the right to request removal of any link to GoMarketMe at any time. You agree to immediately remove any link to GoMarketMe upon request.
Without prior written approval, you may not create frames around our Marketing Site, Platform, dashboards, account pages, administrative pages, or other non-public GoMarketMe pages in a way that alters their visual presentation, misrepresents their source, or creates confusion about ownership, sponsorship, endorsement, or affiliation.
Legitimate GoMarketMe customers, app developers, marketers, and affiliates may embed or iframe public GoMarketMe campaign links, public referral links, public landing pages, or other public campaign materials made available by GoMarketMe for promotional purposes, provided that such embedding is lawful, not deceptive, does not alter the intended functionality of the campaign link, does not interfere with attribution or tracking, and does not falsely imply sponsorship, endorsement, or approval beyond the applicable campaign relationship.
GoMarketMe may restrict, disable, or request removal of any iframe, embed, link, or use of GoMarketMe materials that GoMarketMe reasonably believes is misleading, abusive, unlawful, technically harmful, inconsistent with these Terms, or adverse to the integrity of the Platform or its users.
We are not responsible for any content that appears on your website, app, platform, campaign, affiliate materials, or other properties.
You agree to protect and defend GoMarketMe against claims arising from content, links, materials, promotions, or representations appearing on your website, app, platform, campaign, affiliate materials, or other properties.
No link, embed, iframe, or content associated with GoMarketMe may appear on any website, app, or platform that may be interpreted as libelous, obscene, criminal, misleading, deceptive, infringing, or otherwise unlawful, or that advocates infringement or violation of any third-party rights.

By using GoMarketMe, you consent to the collection, use, and processing of information as described in our Privacy Policy.
We reserve the right to request that you remove any link, iframe, embed, or other reference to GoMarketMe. You agree to immediately remove all such links, iframes, embeds, or references upon request.
We also reserve the right to amend these Terms and our linking policy at any time. By continuing to access, use, link to, or embed GoMarketMe materials, you agree to be bound by the then-current version of these Terms.

GoMarketMe does not guarantee that the Marketing Site, Platform, APIs, SDKs, documentation, campaign links, referral links, attribution features, reporting features, or services will be error-free, uninterrupted, secure, accurate, complete, or available at all times.
GoMarketMe does not guarantee any specific campaign result, affiliate result, app install, purchase, subscription, revenue amount, profit amount, conversion rate, attribution outcome, or business result.
To the fullest extent permitted by applicable law, GoMarketMe Technology, LLC shall not be liable for any damages, losses, or claims, whether direct, indirect, incidental, consequential, special, exemplary, punitive, or otherwise, arising from or relating to your use of, or inability to use, the Marketing Site, Platform, APIs, SDKs, documentation, campaign links, referral links, attribution features, reporting features, or services.
To the fullest extent permitted by applicable law, GoMarketMe shall not be liable for lost profits, lost revenue, lost business opportunities, lost goodwill, loss of data, business interruption, campaign underperformance, affiliate underperformance, attribution discrepancies, payment disputes, account suspension, account termination, or any indirect, incidental, consequential, special, exemplary, or punitive damages, even if GoMarketMe has been advised of the possibility of such damages.
GoMarketMe is not liable for any disruption of service, technical issue, loss of data, loss of revenue, loss of profits, business interruption, account suspension, account termination, unavailability of the services, or inability to access the Marketing Site, Platform, APIs, SDKs, documentation, campaign links, referral links, or related systems.
GoMarketMe is not liable to indemnify marketers, affiliates, developers, users, or any third parties for disruptions, technical issues, loss of revenue, loss of profits, campaign performance, affiliate performance, attribution outcomes, reporting discrepancies, payment disputes, or termination of services.
By using the Marketing Site, Platform, APIs, SDKs, documentation, or services, you agree that you will not file or initiate any patent lawsuit against GoMarketMe Technology, LLC or any of its affiliates, partners, licensors, customers, or users for any claim arising from or related to your use of GoMarketMe’s services.
This section does not limit GoMarketMe’s right to bring claims to protect its intellectual property, confidential information, business interests, systems, users, or services.
These Terms are governed by the laws of the State of Hawaii, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms, the Marketing Site, the Platform, APIs, SDKs, documentation, campaign links, referral links, or services shall be brought exclusively in the state or federal courts located in Honolulu, Hawaii, and each party consents to personal jurisdiction and venue in those courts.
